What Hunter and Gatherer Hawaii is
Hunter and Gatherer Hawaii is a technology platform. We connect local sellers with buyers across the islands. We are not the producer, seller, distributor, handler, inspector, or shipper of any product listed. We do not grow, catch, handle, store, inspect, or deliver any item. Every product is offered, described, and warranted solely by the independent seller who created and listed it. Hunter and Gatherer Hawaii assumes no liability for the quality, safety, legality, or accuracy of any product or seller representation.
Seller responsibility & indemnification
By creating a seller account and listing products, you certify that: (1) you hold all licenses required by Hawaii law for your category; (2) all products comply with applicable Hawaii state and federal safety, health, and food safety standards; (3) you are solely responsible for the legality, safety, quality, freshness, accuracy, and fitness of everything you sell; and (4) your product descriptions and representations are truthful and complete.
Indemnification: You agree to indemnify, defend, and hold harmless Hunter and Gatherer Hawaii LLC, its owners, managers, employees, and agents from all claims, damages, liabilities, costs, and expenses (including attorneys' fees) arising from: (a) any product you list or sell; (b) any breach of this agreement or applicable law; (c) any injury, death, or property damage caused by your product; (d) any dispute between you and a buyer; or (e) any allegation that your product is defective, unsafe, illegal, or misrepresented. This indemnification applies regardless of whether the claim arises from your negligence, breach of warranty, product liability, or strict liability.
License requirements by category
Everything sold must be made, grown, caught, or handcrafted in Hawaii by you. No resale of store-bought goods.
โข Fish & seafood: You must hold a valid Commercial Marine License (CML) issued by Hawaii Department of Land and Natural Resources. Learn about CML requirements.
โข Fresh produce & flowers/lei: No license required, but products must comply with Hawaii health and safety standards.
โข Cottage foods: You must have completed a Hawaii food-safety certification course. You are responsible for compliance with all applicable food safety laws.
โข Wild game is prohibited. Hawaii law prohibits the commercial sale of game mammals from public hunting areas. Violations of this prohibition are violations of Hawaii law, and you are solely liable.
Insurance & the Insured Seller badge
Sellers are not required to carry liability insurance to list โ it's optional. Sellers who maintain a valid product or food liability insurance policy may earn a badge on their listings:

The badge is earned, never bought. Carrying insurance is your choice and does not reduce your indemnification obligations to Hunter and Gatherer Hawaii.
Payments, escrow & seller confirmation
All payments are processed through Stripe and held in escrow until you confirm inventory and fulfill the order. No cash transactions, ever. When a buyer places an order, you have 2 hours (for perishables) or as specified in the order to confirm that you have the product in stock. If you fail to confirm within the required window, the order is automatically cancelled and the buyer's payment is released back to their card โ no platform fee is charged because no sale occurred.
Once you confirm inventory, the buyer dispute window begins. Pickup or delivery details are shared only after confirmation. Hawaii General Excise Tax (GET) at 4.712% is added as its own line at checkout and is paid by the buyer.
Platform fees
Buyers pay zero platform fees. Sellers pay a platform fee only on completed sales: 8% for founding sellers (locked permanently), 9% standard, and 7% on wholesale orders over $500. Fees are deducted from escrow before payout.
Disputes & liability limitation
Buyers may raise a dispute within 2 hours for perishable items and 7 days for non-perishables. Disputes are reviewed by Hunter and Gatherer Hawaii with a clear escalation path. Hunter and Gatherer Hawaii's total liability for any claim, dispute, or transaction is limited to zero dollars. We are a platform only and do not warrant, guarantee, or assume liability for any product, transaction, or buyer-seller dispute.
Account suspension & removal
We may suspend, remove listings, or terminate your account if: (a) you violate these terms; (b) you breach any applicable law; (c) you fail to maintain required licenses; (d) we receive complaints about product safety or quality; or (e) we determine your presence on the platform poses risk to buyers or the platform. Reviews, ratings, and seller reputation are owned by Hunter and Gatherer Hawaii and are non-transferable.
Legal references
This platform operates under Hawaii law. Sellers are responsible for compliance with Hawaii Commercial Marine License requirements, Hawaii food safety standards, and all applicable state and federal laws. Hawaii marketplace facilitators are responsible for General Excise Tax collection per HRS ยง 237-4.5.
Messages & dispute resolution
All messages between buyers and sellers are recorded, timestamped, and permanently retained for dispute resolution and legal compliance. Messages cannot be deleted by users. The platform permanently archives all buyer-seller messages, meeting point proposals, and transaction communications to ensure a complete dispute trail.
Admin access to profiles and messages: Hunter and Gatherer Hawaii's administrator reserves the right to review seller profiles, buyer information, transaction details, and all messages (buyer-seller correspondence, meeting point agreements, and communication history) for purposes of: (a) dispute resolution and investigation; (b) platform security and abuse prevention; (c) regulatory compliance; (d) quality assurance; and (e) legal proceedings. Users acknowledge and agree that their messages and communications are accessible to the platform administrator for these purposes.

What we collect
Account details you provide (name, email, phone, island), your listings and license information, transaction records needed to process orders and payments, and communications between buyers and sellers.
How we use your data
To operate the marketplace: create and manage your account, publish listings, process payments, verify licenses, send order and renewal notifications, prevent fraud, provide support, and comply with applicable law including Hawaii General Excise Tax (GET) requirements.
Service providers
We use trusted third-party processors to operate: Stripe for payment processing and escrow, Supabase for secure database storage and authentication, and Twilio for SMS notifications. They handle your data only to provide their service to us and are bound by confidentiality obligations.
Data security & breach notification
We use industry-standard technical and administrative safeguards to protect your data. However, no system is perfectly secure. If a data breach occurs involving your personal information, we will comply with Hawaii's Data Breach Notification Law (HRS ยง 487N-1) and notify affected individuals without unreasonable delay. If the breach affects more than 1,000 Hawaii residents, we will also notify the Hawaii Office of Consumer Protection.
You assume the risk of data storage and transmission inherent in using an online platform. While we make reasonable efforts to protect your data, we cannot guarantee absolute security.
What we don't do
We never sell or rent your personal information to third parties for marketing or other purposes.
Your control & rights
You can request access to, correction of, or deletion of your personal data at any time. Email admin@hunterandgathererhawaii.com with your request, and we will respond within a reasonable timeframe. Note that some data (transaction history, license records) may be retained for legal and tax compliance purposes.
Message retention & platform access
All buyer-seller messages, meeting point proposals, and transaction communications are permanently retained in our database for dispute resolution, legal compliance, and fraud prevention. Messages cannot be deleted by users. We maintain a complete immutable record of all conversations associated with your account.
Administrator access: The platform administrator has full access to all seller profiles, buyer information, transaction details, and messages for purposes of dispute resolution, fraud investigation, regulatory compliance, and platform security. By using this platform, you acknowledge that your personal information and communications may be reviewed by the administrator as necessary to operate the marketplace.
